Hawaii State Highway Right-of-Way Overview (3-HI-c)

In Hawaii, a developer may need a Use and Occupancy Permit and/or a Permit to Construct Upon a State Highway from the Hawaii Department of Transportation Highways Division (HDTHD) to perform construction adjacent to and within the highway right-of-way, and/or park on a restricted section of highway under state jurisdiction. H.A.R. 19-105. A developer may also need approval from HDTHD to cross or enter the State Energy Corridor on Oahu.



State Highway Right-of-Way Overview Process


3-HI-c.1 to 3-HI-c.3 – Will the Activity Require Construction Adjacent to or within a Highway Right-of-Way?

If the project will perform construction adjacent to and within a highway right-of-way and/or park on a restricted section of highway under state jurisdiction, the developer needs to apply for a Use and Occupancy Permit from the Hawaii Department of Transportation Highways Division. H.A.R. 19-105-5.

3-HI-c.4 to 3-HI-c.5 – Will the Project Perform Work within a State Highway Right-of-Way?

If the project will require work within a State Highway Right-of-Way the developer must obtain a permit from the Hawaii Department of Transportation, Highways Division. H.R.S. 264-7.

3-HI-c.6 –to 3-HI-c.8 – Will the Project Perform Construction to Cross or Enter the State Energy Corridor on Oahu?

If the project will perform construction to cross or enter the State Energy Corridor on Oahu, a developer must apply for an approval letter from the Hawaii Department of Transportation Harbors Division, Engineering Branch.
