Regie de l'energie Authorization Process
8-QC-d.1 – Does the Project Cost $65 Million?
A developer must receive an Authorization from the Régie de L’énergie to construct a transmission line involving the transmission of electric power worth $65 million or more. Quebec – Decree Amending Conditions and Cases Requiring Authorization from Régie de L’énergie 789-2019.
8-QC-d.2 to 8-QC-d.3 – Has the Project Been Authorized Via Generic Demand?
A developer must receive an Authorization from the Régie de L’énergie for a transmission line worth less than $65 million if the project has not yet been recognized as prudently acquired and useful for the operation of the electric power transmission system pursuant to R.S.Q. 1996, c. R-6.01 s. 49. Quebec – Authorization by Régie de L’énergie Regulation c. R-6.01, r. 2.
8-QC-d.4 to 8-QC-d.5 – Application for (Specific or Generic) Regie de l’energie Authorization
A developer must apply to the Régie de L’énergie for authorization of a transmission project. An Application for authorization must contain:
- The project objectives;
- The project description;
- The justification of the project about the objectives;
- The project costs;
- The project feasibility study;
- The list of authorizations required under other laws;
- The impact on the rates including a sensitivity analysis;
- The impact on the reliability of the electric power transmission system and on the quality of the electric power transmission service or electric power or natural gas distribution service;
- The list of the principal technical standards applicable to the project;
- Sales forecasts for the electric power or natural gas distributors’ project where applicable;
- The contractual commitments of the consumers of the service and their financial contributions, where applicable; and
- Any other solutions contemplated, which must include the information referred to in the preceding paragraphs.
Projects Seeking Generic Authorization
In addition to the above, an Application for generic authorization of a must also contain the following:
- The descriptive summary of the investments and their objectives;
- The costs based on the investment category;
- The justification of the investments with regard to the objectives;
- The impact on rates; and
- The impact on the reliability of the electric power transmission system and the quality of the electric power transmission service or electric power or natural gas distribution service.
8-QC-d.6 to 8-QC-d.7 – Review Application Materials for Completeness
The Regie de L’energie will review the Application materials for administrative and technical completeness. If an application does not meet the Application requirements, the Regie may refuse to process the application as submitted, return it to the applicant, indicate the missing information, and if needed suspend examination of the application until the missing information is provided. 8-QC-d.8 to 8-QC-d.10 – Review Application Materials for Approval
The Régie de L’énergie must review the application for authorization for approval. The Régie de L’énergie may authorize a project on any condition it deems necessary. R.S.Q. 1996, c. R-6.01 s.73. When examining an application for authorization, the Regie must consider economic, social, and environmental concerns that have been identified by the Provincial Government. R.S.Q. 1996, c. R-6.01 s.73. The Regie must also consider, the contractual commitments of the consumers served by the proposed project and where applicable, their financial contributions to the acquisition or construction of the economic feasibility.
