Oklahoma State Land Right-of-Way (3-OK-b)

In Oklahoma, a developer may need a State Land Easement from the Commissioners of the Land Office (the Commissioners) to access state land. OK. Const. art. VI-32; Oklahoma Commissioners of the Land Office — Easements Webpage. The Commissioners have the power to grant easements over public lands for utility corridor’s, which includes building powerlines. Oklahoma law refers to these public lands as “school lands” because any profits derived from these lands must be used for public education. OK. Const. art. State Land Right-of-Way Process


3-OK-b.1 — Application for State Land Easement

The developer must submit a State Land Easement Application (Application) to the Oklahoma Commissioners of the Land Office (the Commissioners) to construct powerlines or roads on Commissioners designated state land. State Land Easement Process and Procedures. The Application must include a survey with centerline and a legal description of the land in question. The Application must also include three copies of the certified plat/survey, and a non-refundable Application fee and deposit to secure a possible State Land Easement - Temporary Construction Permit. 3-OK-b.2 to 3-OK-b.3 — Review Application for Completeness

After receiving the Application, the Commissioners review the Application for administrative and technical completeness. If the Commissioners have any questions regarding the application, they will contact the developer for additional information. State Land Easement Process and Procedures.

3-OK-b.4 to 3-OK-b.6 — Review State Land Easement Application for Approval

If the Application is complete the Commissioners review the Application and make a decision on granting or rejecting the Application State Land Easement Process and Procedures. If the Commissioners choose to grant the State Land Easement, then the Commissioners will issue a State Land Easement - Temporary Construction Permit. State Land Easement Application.

3-OK-b.7 — Appraise the Land

The Commissioners must then have the state land appraised by the appropriate Real Estate Management Specialist in order to determine the state lands value and the final amount due to secure the State Land Easement. State Land Easement Process and Procedures.

3-OK-b.8 — Pay Amount Due

The developer must pay the valuation given to the state land by the Real Estate Management Specialist in order to secure the State Land Easement. State Land Easement Process and Procedures.

3-OK-b.9 — State Land Easement

The Commissioners may issue a State Land Easement after approving the Application and once the developer pays the amount due. The Commissioners issues State Land Easements for a maximum of 20 years to non-state governmental entities. The developer may apply for renewal of a State Land Easement in 20 years by submitting a State Land Easement Application 20 Year Renewal to the Commissioners’ Office. 3-OK-b.10 — Appeal Decision (Optional)

A developer may appeal the Commissioners’ decision for judicial review under Ok. Stat. Ann. §75-318.
