New Mexico State Highway Right-of-Way Overview (3-NM-c)

In New Mexico, a developer may need approval from the New Mexico Department of Transportation (NMDOT) District Offices for a project that will encroach upon the State’s rights-of-way (ROWs). If a project will encroach on existing state ROWs, the District Engineers from six districts have authority to approve permits for the construction of utility facilities within a state ROW as well as construction, relocation or modification of an access point to state ROWs.

3-NM-c.1 to 3-NM-c.2 – Does the Proposed Activity Require Utility Lines within the New Mexico Department of Transportation Right-of-Way?

If the proposed project or activity requires any utility lines to be located within the NMDOT ROW, the developer should consult with the New Mexico Department of Transportation. See: Public Highway Utility Accommodation Permit:

3-NM-c.3 to 3-NM-c.5 – Does the Proposed Activity Require a New, Modified or Relocated Access Point on Public Right-of-Way?

If the proposed project or activity requires the construction, modification or relocation of any temporary or permanent access points on public ROWs, the developer should consult with the New Mexico Department of Transportation. See: Permit to Construct Access Opening on Public ROW :

If neither of the above permits is required for the project, the developer may proceed with the project.
