Kentucky State Land Right-of-Way (3-KY-b)

In Kentucky, a developer may need a State Land Lease or other approval from the Kentucky Finance and Administration Cabinet or other state agency with jurisdiction to access state owned land for project development. KY. Rev. Stat. Ann. §56.463(6). The Kentucky Finance and Administration Cabinet has authority “to lease any real property, or any interest in such real property, owned by the state or any agency thereof” pursuant to KY. Rev. Stat. Ann. §56.463(6). State agencies cannot lease state lands unless the Kentucky Finance and Administration Cabinet has delegated the authority to the agency. KY. Rev. Stat. Ann. §56.500(2), KY. Rev. Stat. Ann. §45A.045(3).



State Land Right-of-Way Process


3-KY-b.1 to 3-KY-b.3 — Is the Project Located on State Agency Land?

If the project is located on state agency land, the developer should contact the state agency to determine if they have authority to lease the land.

3-KY-b.4 — Contact the Finance and Administration Cabinet

The developer should contact the Kentucky Finance and Administration Cabinet if the project is not located on state agency land or the state agency does not have the authority to lease the land.
