New Mexico Permit to Drill a Well with No Consumptive Use of Water (19-NM-b)

In New Mexico, a geothermal developer may need to obtain a Permit to Drill a Water Well from the New Mexico Office of the State Engineer (NMOSE) if the project requires drilling a new water well with no consumptive use of water. NMSA 72-12-12.



Permit to Drill a Well with No Consumptive Use of Water Process


19-NM-b.1 – Application for Permit to Drill a Well with no Consumptive Use of Water

The developer must submit an Application for Permit to Drill a Well with No Consumptive Use of Water to NMOSE, and include all necessary information. The application will include information on the location of the well, a description of the project, and a fee not to exceed $25. NMSA 72-12-13 .


19-NM-b.2 to 19-NM-b.3 – Review Application Materials for Completeness

NMOSE will review application materials to ensure completeness. NMOSE may request additional information from the developer. NMSA 72-12-13 .

19-NM-b.4 – Construct Water Well

The developer must hire a New Mexico licensed well driller to complete the drilling and construction of the well. NMSA 72-12-12.

19-NM-b.5 – Proof of Completion of Well

The developer is required to submit a Proof of Completion of Well form with OSE following completion of the well.

19-NM-b.6 – Complete Well Record

After the licensed well driller constructs the well, the driller must complete a Well Record. The developer is then required to file the complete Well Record with NMOSE no later than 20 days after drilling is complete. If the Well Record is not received by the expiration date of the permit, the permit automatically expires and a new permit and fee will be required for any drilling beyond the permit expiration date.
