Montana Underground Storage Tank Permit (18-MT-a)

In Montana, a geothermal developer must obtain an Underground Storage Tank Installation Permit before installing an underground storage tank system. The United States Environmental Protection Agency (EPA) granted the Montana Department of Environmental Quality (DEQ) authority to regulate the installation of underground storage tanks through authorizing the Montana Underground Storage Tank Leak Prevention Program under the Montana Underground Storage Tank Act (MCA 75-11-501). Montana's Leak Prevention Program aims to protect human health and the environment by preventing the release of petroleum and hazardous substances into groundwater resources. The DEQ issues regulations in furtherance of the Leak Prevention Program through ARM 17.56.



Underground Storage Tank Permit Process


18-MT-a.1 – Underground Storage Tank Installation Permit Application

A developer must submit a complete permit application on a form provided by the DEQ at least 30 days prior to the installation of a major installation or 20 days prior to a minor installation. ARM 17.56.1303.


18-MT-a.2 to 18-MT-a.3 – Review Application Materials for Completeness

The DEQ reviews the application materials for completeness and must notify the developer/applicant if the department determines that an application is incomplete. The DEQ must provide the developer/applicant an explanation of the missing application information and must hold the incomplete application until receipt of the additional required information. An incomplete permit application expires when the developer/applicant fails to respond to the DEQ’s notice of permit application deficiencies within six months of receiving the notice. ARM 17.56.1303.


18-MT-a.4 – Review Application Materials

The DEQ reviews the application material and determines whether to issue the Underground Storage Tank Installation Permit. The DEQ’s determination is based on whether the installation will comply with applicable statutes and rules of the department and whether the developer/applicant will conduct the installation in a place and in a manner as to protect the environment as well as public health, welfare, and safety. ARM 17.56.1305.


18-MT-a.5 – Underground Storage Tank Installation Permit

Upon application approval, the DEQ issues an Underground Storage Tank Installation Permit to the developer/applicant. The Permit must include:

  • The name of the owner or operator to whom the DEQ issued the permit;
  • The address or location of the site at which the installation may occur;
  • The date when the developer plans to install the underground storage tank system;
  • The name and license number of the licensed installer who will install the underground storage tank system;
  • Whether the department or a local inspector will inspect the underground storage tank installation and if a local inspector, the name of the inspector; and
  • Any special conditions necessary to ensure compliance with applicable statutes and rules.

18-MT-a.6 – Forward Copy of Permit to Local Inspector

Upon issuance of an Underground Storage Tank Installation Permit, the DEQ must forward a copy of the permit to any local inspector conducting an inspection of the installation. ARM 17.56.1305.


18-MT-a.7 – Sign and Return Copy of Permit

If a licensed installer conducts the installation, the installer must sign and return a copy of the permit to the DEQ within 30 days of the installation. If the owner or operator of the storage tank with an on-site installation inspector conducts the installation, the owner or operator must sign and return a copy of the permit, along with any compliance checklist or document, to the DEQ within 30 days of the installation. ARM 17.56.1305.
