Washington State Cultural Considerations Overview (11-WA-a)

In Washington, a person (developer) may need a permit or other approval from the Washington State Department of Archaeology and Historic Preservation if human remains or cultural resources are discovered during project construction or development.


Cultural resources include both historic and archaeological resources and sites. The discovery of cultural resources may require the developer to obtain a permit and prove notice to the public and affected Indian Tribes. The Washington State Governor’s Office of Indian Affairs has compiled a list of federally recognized Indian Tribes in the Washington State Tribal Directory. Washington State does not have state-recognized tribes. Washington State Tribal Directory. However, the developer and the State must consult with both federally recognized and non-federally recognized Tribes regarding potentially affected cultural resources on tribal land.

11-WA-a.1 to 11-WA-a.2 – Have Potential Human Remains Been Discovered?

If the developer discovers potential human remains during any part of the development process, then they must contact the proper authorities and comply with all requirements for removal. For more information, see:

11-WA-a.3 to 11-WA-a.5 – Have Other Cultural Resources Been Discovered?

If other cultural or archaeological resources are discovered during development, the developer must comply with applicable state requirements for removal. The developer may be required to obtain an Archaeological Site Alteration and Excavation Permit from the Washington State Department of Archaeology and Historic Preservation.
