In Montana, a person (developer) must consider the project's impact on state cultural and historical resources. MCA 22-3-802 Both the state and its citizens have a responsibility to protect human remains from disturbance and destruction. MCA 22-3-802 .

11-MT-a.1 to 11-MT-a.2 - Have Potential Human Remains Been Discovered?

If the developer discovers human skeletal remains, a burial site, or burial material during construction or other ground-disturbing activity, the developer must proceed under the Montana Human Skeletal Remains and Burial Site Protection Act. For more information, see:

11-MT-a.3 to 11-MT-a.5 - Have Other Cultural Resources Been Discovered on State Land?

If the developer discovers a "heritage property or paleontological remains" on state property must proceed under the state cultural resource process. MCA 22-3-421. For more information, see:
