The Tennessee Air Quality Act (AQA) delegates the power to maintain air quality in the State to the Department of Environment and Conservation. Under the Department of the Environment and Conservation the Division of Air Pollution Control is directed to maintain the purity of the air resources of the State of Tennessee consistent with the protection of normal health, general welfare, and physical property of the people while preserving maximum employment and enhancing the industrial development of the State. The AQA is a comprehensive set of permitting requirements, environmental regulations, siting criteria, pollution standards and air quality standards that have an effect on all new energy activities. The AQA establishes the Division of Air Pollution Control as the authority to issue permits required under this act. The following permits are required for any project: Construction Permit (#CN-0730 - APC 20), New Construction Operating Permit if emitting less than 10 tons per year (#CN-0730 - APC 20), Title V operating Permit (CN-1007). In addition Fuel Burning Source Description Forms (#CN-0741 - APC 21) and Emission Point Description Forms (Form #CN-9742 - APC 22) are required for most projects.
