Tennessee Hydropower Biological Resource Assessment(12-TN)

In Tennessee, the Tennessee Wildlife Resources Agency (TWRA) may conduct a biological resource assessment of the proposed hydropower project and issue, to the Federal Energy Regulatory Commission (FERC), a defensible set of recommendations designed to protect, mitigate damage to, and enhance fish and wildlife resources. Hydropower projects on US Army Corps of Engineers nonpowered dams or conduits are not eligible for a FERC exemption and therefore are not subject to mandatory terms and conditions pursuant to section 30(c) of the Federal Power Act, but Tennessee Wildlife Resources Agency may issue section 10(j) license recommendations. A developer should consider the project’s impact on flora and fauna and comply with federal and state biological resource law.
