North Dakota Hydropower Biological Resource Assessment(12-ND)

In North Dakota, the North Dakota Game and Fish Department (NDGF) may conduct a biological resource assessment of the proposed hydropower project and issue, to the Federal Energy Regulatory Commission (FERC), a defensible set of recommendations designed to protect, mitigate damage to, and enhance fish and wildlife resources. US Army Corps of Engineers hydropower projects are not exempt from FERC licensing, and therefore are not subject to NDGF mandatory terms and conditions pursuant to section 30(c) of the Federal Power Act.
