The construction of new structures in navigable waterways requires a permit from the Department of Natural Resources. Existing structures in waterways newly classified as “navigable” are not affected by this classification, unless they have been abandoned for at least 12 months.
The board of county commissioners of each county may declare any stream or watercourse in the county navigable on the petition of at least twenty-four (24) freeholders of the county residing in the vicinity of the stream.
