These regulations set minimum distance requirements between certain types of facilities that generate, process, store, and dispose of hazardous waste and other land uses. The regulations require an applicant for a proposed hazardous waste facility to demonstrate that the health and safety of all persons in schools, hospitals, nursing homes, and occupied dwellings within 2000 feet of the proposed facility will not be threatened. The minimum required distance to the nearest land uses may be reduced if the applicant sufficiently demonstrates that it will not pose an increased risk to the public.
