The Department of Health is the designated agency to administer and coordinate a hazardous waste management program to provide for the reduction of hazardous waste generation, reuse, recovery, and treatment as preferable alternatives to landfill disposal; the safe and adequate management of hazardous waste; and the reduction of surface and ground water contamination.

The Department regulates the management of hazardous waste and underground storage tanks; provisions for permitting and fees are located in chapter 23-20.3, while specific regulations can be found in chapter 33-24 of the ND Administrative Code.
