Abstract
The Commission approved a settlement provision requiring dispute resolution terms for the relicense of several hydropower projects with a combined capacity of 125 MW on the Sacandaga and Hudson Rivers in New York. The Commission reasoned that “because dispute resolution can significantly reduce transaction costs of litigation before the Commission over license disputes,” it would include the dispute resolution provision in that license, but that the provision would only be enforceable against the licensees.
