Permit Overview Section 402 of the federal Clean Water Act established the National Pollutant Discharge Elimination System (NPDES). The [[United States Environmental Protection Agency]] (EPA) administers NPDES and in some cases delegates administrative authority to state agencies. New Mexico does not have the authority to issue construction stormwater permits under NPDES. However, the Surface Water Quality Bureau (SWQB), within the [[New Mexico Environment Department]], assists the EPA in the regulation of stormwater discharges by performing inspections on behalf of the EPA and serving as the local point of contact for providing information to operators and other agencies regarding the federal regulatory program.
